Q: What is Multisearch®?

Q: Is a Multisearch IdenticalPlus sufficient to find out whether my trademark is available?

A: Multisearch IdenticalPlus is advisable to make a selection of marks that are prima facie available. This search is not sufficient to clear a mark. In order to provide you with the full picture whether the mark is available, a subsequent full EU availability search by Multisearch need to be done.

Q: What is the difference between Multisearch Pro and Multisearch Lite?

A: The Multisearch Pro search is designed to clear a trademark. Local EU attorneys provide their analysis of the candidate mark in their own country, taking local laws and regulations into account. The search report will give valuable guidance on the registrability and availability for registration and use of the mark. The Multisearch Lite search is a more cost-effective way to make a calculated risk assessment of the availability of a mark. The data is analyzed by one specialized EU trademark attorney who provides an overall opinion instead of a local EU attorney for each country separately

Q: Who provides the legal opinion on a search report?

A: For the Benelux countries Knijff Trademark Attorneys’ senior trademark attorneys prepare the legal opinions. The opinions on the searches in the other countries are provided by local associates from our Multisearch network.

Q: How do you monitor the quality of the searches?

A: We carefully select the attorneys that we work with in the EU countries. We discuss client's requirements, train/manage them where necessary and assess their efforts periodically. The same applies to the attorneys within our firm that are involved in the process.

A: When you want to know if a certain domain name is still available and has not already been registered by any third party a domainname check should be performed. This check is conducted in TLD's and ccTLD's registers.

Q: What is a pharma in use check?

A: When you want to verify whether there is any record of sales of a pharmaceutical product bearing a certain trademark in order to establish whether the mark is in use or not this pharma in use check should be performed. This check is conducted in the relevant Pharma In Use register.

Q: What is a Internet check?

A: When you want to check whether a certain trademark is actually in use, in which countries and for which products an Internet check should be performed. This check is conducted on the world wide web with 600 million Web pages, and all ICANN-accredited domain name registers. It uses advanced filtering tools to provide only relevant trademark references.
